The Hire Lab, LLC is committed to providing professional, confidential, and compliant screening and verification services. Because requirements governing drug testing, background screening, DNA testing, fingerprinting, and employment eligibility verification may vary based on the service, purpose, client, industry, and applicable federal, state, and local laws, the following disclosures apply.

1. General Compliance Disclaimer

The Hire Lab, LLC provides screening, collection, verification, and related services in accordance with applicable laws, regulations, contractual requirements, and the requirements of authorized laboratories, government agencies, screening providers, and other applicable entities.

The Hire Lab does not provide legal advice. Information contained on this website is provided for general informational purposes and should not be considered legal advice or a substitute for consultation with qualified legal counsel.

Clients are responsible for ensuring that their employment practices, screening policies, authorizations, notices, and use of screening information comply with applicable laws and regulations.

2. Drug & Alcohol Testing

Drug and alcohol testing services may be subject to federal, state, and local laws and regulations, as well as applicable industry-specific requirements.

For Department of Transportation (DOT) testing, applicable DOT regulations and procedures govern the testing process, including collection, laboratory testing, Medical Review Officer review, reporting, and recordkeeping requirements.

Non-DOT testing is subject to the requirements applicable to the employer, testing program, laboratory, jurisdiction, and specific test being administered.

The Hire Lab does not determine whether an individual should be hired, terminated, disciplined, or otherwise subjected to an employment action based solely on a test result. Employment decisions remain the responsibility of the employer or authorized decision-maker.

Test results are handled as confidential information and disclosed only to authorized parties or as otherwise permitted or required by applicable law.

3. Background Checks & FCRA

Employment-related background screening may be subject to the Fair Credit Reporting Act (FCRA) and applicable state and local laws.

When a background report is obtained for employment purposes through a consumer reporting agency, applicable FCRA requirements may include providing required disclosures, obtaining the individual’s authorization, maintaining a permissible purpose, following applicable dispute procedures, and complying with required pre-adverse and adverse-action procedures.

Employers are responsible for using background information consistently and in compliance with applicable equal employment opportunity and anti-discrimination laws. Federal guidance confirms that employers must not use background information in a discriminatory manner and that additional FCRA obligations apply when consumer reports are used for employment decisions. The Hire Lab does not make hiring, promotion, retention, termination, or other employment decisions on behalf of a client unless expressly authorized under a separate agreement. The employer or authorized client remains responsible for employment decisions and compliance with applicable employment laws.

4. Fingerprinting & Identity Verification

Fingerprinting and identity verification services may be performed for employment, licensing, certification, regulatory, governmental, educational, or other authorized purposes.

Fingerprint submissions may be transmitted to an authorized government agency, licensing authority, employer, screening provider, or other designated recipient depending on the purpose of the service.

Individuals are responsible for providing accurate identifying information and following all applicable instructions for fingerprint submission.

The Hire Lab does not control the processing, retention, determination, or final disposition of fingerprint records after they have been submitted to an authorized third party or government agency.

Additional privacy, record-retention, disclosure, and appeal requirements may apply depending on the agency or program receiving the fingerprints.

5. DNA Testing

DNA testing services are provided only for authorized purposes and may require informed consent and identification of the individuals providing biological samples.

DNA testing results and genetic information are treated as highly confidential information. Information will be disclosed only to authorized individuals or entities or as permitted or required by applicable law.

When DNA testing is connected to employment or employment-related decision-making, additional legal restrictions may apply. The Genetic Information Nondiscrimination Act (GINA) generally prohibits covered employers from using genetic information in employment decisions and restricts employers from requesting, requiring, or purchasing genetic information, subject to limited exceptions. The Hire Lab does not use genetic information to make employment decisions.

DNA testing performed for legal, immigration, family relationship, court, or other regulated purposes may be subject to additional requirements concerning chain of custody, identification, consent, laboratory accreditation, and documentation.

6. I-9 Employment Eligibility Verification

Form I-9 is used by employers to verify the identity and employment authorization of individuals hired for employment in the United States.

The Hire Lab may provide I-9-related services or assistance as authorized by the employer. Employers remain responsible for completing and maintaining Form I-9 and for complying with applicable federal requirements.

I-9 information and supporting documentation may contain sensitive identity and employment authorization information and will be handled in accordance with applicable requirements.

The Hire Lab does not guarantee an individual’s eligibility for employment and does not make immigration or employment authorization determinations on behalf of the federal government.

7. Equal Employment Opportunity

Background screening, drug testing, and other employment-related screening programs must be administered consistently and in accordance with applicable anti-discrimination laws.

Employers should ensure that screening requirements are job-related, appropriately applied, and consistent with applicable federal, state, and local requirements. Federal guidance from the EEOC states that employers may not use background information in a manner that unlawfully discriminates against applicants or employees. (EEOC⁠)

8. Accuracy of Information

The Hire Lab makes reasonable efforts to accurately collect, process, and transmit information provided by clients and individuals.

However, The Hire Lab does not guarantee the accuracy, completeness, or availability of information supplied by an individual, employer, laboratory, government agency, database, consumer reporting agency, or other third-party source.

Individuals who believe information contained in a report is inaccurate may have rights to dispute that information with the appropriate reporting or screening provider.

9. Third-Party Providers

The Hire Lab may work with authorized laboratories, consumer reporting agencies, background screening providers, technology platforms, payment processors, government agencies, and other service providers necessary to fulfill requested services.

Third-party providers may have their own privacy policies, security practices, legal requirements, and terms of service. The Hire Lab is not responsible for the independent practices of third parties beyond its contractual and legal responsibilities.

10. No Guarantee of Employment Outcome

Completion of a background check, drug test, fingerprinting service, DNA test, or I-9-related service does not guarantee employment, continued employment, licensing, certification, approval, eligibility, or any other outcome.

Employment and eligibility decisions are made by the appropriate employer, government agency, licensing authority, or other authorized decision-maker.

11. Changes in Laws and Requirements

Federal, state, and local laws and regulatory requirements may change. The Hire Lab reserves the right to modify its procedures, forms, services, and website disclosures as necessary to remain consistent with applicable requirements.

Clients are encouraged to consult qualified legal counsel regarding their specific employment-screening, privacy, compliance, and regulatory obligations.

Nothing on this website or in communications from The Hire Lab, LLC should be interpreted as legal advice.

The Hire Lab provides professional screening and verification services and does not act as legal counsel for employers, applicants, employees, or other clients.

By using The Hire Lab’s services, clients acknowledge their responsibility to use screening and verification information in accordance with applicable laws, regulations, contractual requirements, and authorized purposes.
